Online store Terms & Conditions

This is a translation provided for convenience. The Polish-language version is binding.

1. General provisions

These Terms & Conditions define the rules for using the online store operated at www.cremebar.pl, in particular:
  • rules for placing orders,
  • rules for concluding and performing sales agreements,
  • payment rules,
  • delivery rules,
  • liability rules,
  • complaint rules,
  • withdrawal rules,
  • rules for accessing the B2B sales system.
The Seller is Creme Bar Bjorn Lieske, registered in Radomierzyce, ul. Różana 1, 55-010 Radomierzyce, entered in CEIDG, Tax ID (NIP): 8951687495, REGON: 381330222.

Address for complaints and returns: ul. Fabianowska 116, 62-052 Komorniki.

These Terms form an integral part of every sales agreement.

The store conducts sales to:

  • B2C - exclusively in Poland,
  • B2B - in Poland and other countries.

The Customer is obliged to read these Terms before concluding the agreement. The Terms are made available free of charge on the Store's website in a way that allows them to be saved, reproduced and printed.

2. Definitions

  • Customer - an entity making a purchase in the Store.
  • B2C Customer - consumer.
  • B2B Customer - an entrepreneur making a purchase in connection with their professional activity.
  • Product - goods offered in the Store.
  • Component products - products intended for self-preparation of the final product.
  • Personalisation system - a sales model based on the Customer preparing the product themselves.
  • Training - an element of the starter package conditioning access to the B2B system.

3. Nature of products and liability

Products are new, marked with batch numbers and an expiry date.

Component products are intended exclusively for B2B Customers.

The Seller does not combine products - the final product is created by the Customer themselves.

The B2B Customer is obliged to follow the guidelines, properly store and use products as intended.

The Seller is liable for the quality of the supplied Products and is not liable for the final product prepared by the Customer.

4. Placing orders and concluding the agreement

Orders are placed via the form on the Store's website.

Before placing an order, the Customer can verify and correct the data.

The order is placed by clicking the button labelled „I buy and pay” or equivalent.

The agreement is concluded when the order is confirmed by the Seller.

The Seller may refuse to process the order in the case of:

  • incorrect data,
  • violation of the Terms,
  • payment arrears,
  • reasonable suspicion of abuse,
  • actions against the Seller.

5. Prices, currencies and VAT

Prices depend on the Customer's status and market:

  • B2C - Poland (PLN)
  • B2B - Poland (PLN), EU (EUR), UK (GBP)

Delivery costs and the total price are presented before placing an order. The Seller may apply free-delivery thresholds.

The B2B Customer is obliged to provide an EU VAT number. Otherwise Polish VAT is charged.

6. Payments

Payments are processed via Stripe.

The Seller may grant deferred payment terms to B2B Customers.

In case of delays, the Seller may restrict access to services or suspend order fulfilment.

7. Delivery and risk transfer

Delivery is carried out by courier companies.

Lead time: 1-3 business days.

  • B2C - risk passes upon receipt by the Customer.
  • B2B - risk passes upon handover to the carrier.

8. B2B system and cooperation

Access to the system requires:

  • the starter package,
  • training,
  • a certificate.

The Seller may restrict or terminate cooperation in the event of a breach of rules. Copying the system or using know-how outside the cooperation is prohibited.

9. Premium status

Premium status is granted for 6 months.

After this period it is subject to verification.

10. Complaints

B2C

The Customer is entitled to: repair, replacement, price reduction or withdrawal from the agreement.

A complaint may be submitted by email to biuro@cremebar.pl or in writing to: ul. Fabianowska 116, 62-052 Komorniki.

The Seller responds within 14 days. Delivering the product may be required.

B2B

Complaint within 7 days of detection.

Required: defect description, batch number, photographic documentation. Liability covers only the products, not the final product.

11. Withdrawal from the agreement

B2C

Right of withdrawal within 14 days of receipt of the goods, without giving a reason. Return cost borne by the Customer. Refund within 14 days. The Seller may withhold the refund until the product is received.

Exclusions

No right of withdrawal for:

  • sealed products whose packaging has been opened after delivery,
  • products that perish quickly or have a short expiry date,
  • products created to the Customer's specification or clearly personalised.

B2B

No right of withdrawal from the agreement.

12. Know-how

All training materials, working methods, solutions and the sales system are the property of the Seller and are protected by copyright. Copying, reproducing or sharing them with third parties is prohibited.

13. Personal data

Data is processed in accordance with the Privacy Policy available on the Store's website.

14. Final provisions

These Terms are governed by Polish law.

Consumers may use the Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr.

The Seller may amend the Terms for important reasons. Changes take effect 7 days after publication. The Terms in force at the time of concluding the agreement apply to orders.
